Work Visa and Petition Process
The United States runs an employer-led, multi-agency system. You obtain a prevailing wage determination and labor certification from the Department of Labor, file the petition with USCIS, then the named worker is processed by the National Visa Center and interviewed at the US Embassy in Manila. Because H-2A and H-2B are restricted to nationals of countries on the DHS eligible-country list — and the Philippines is currently not on it — Filipino hiring runs mainly through the employment-based immigrant route, with Schedule A pre-certification for registered nurses and physical therapists. On the Philippine side the employer must be accredited with the Migrant Workers Office covering its state, and the contract must be verified before deployment.
