Work Permit and Visa Process

Germany admits third-country workers under the Residence Act (AufenthG) as reformed by the Skilled Immigration Act. Employers choose between the qualification pillar, the experience pillar under § 19c(2) AufenthG and the EU Blue Card, with the Federal Employment Agency approving pay parity under § 39 AufenthG. Qualification recognition, or a Recognition Partnership, sits at the centre of the file, and the accelerated procedure under § 81a AufenthG can compress the timeline. Praxis runs the recognition, the authority lane, the D visa step and DMW clearance as one connected process.

What happens inside the lane

Typical range: 10–20 weeks
  1. 01Job Order Approval (DMW)

Recruitment opens only after the job order is verified under Philippine DMW rules — employer documents, manpower request and the model employment contract are cleared first.

  2. 02Route Selection Under the Skilled Immigration Act

Germany admits third-country workers under the Residence Act (AufenthG) as reformed by the Fachkräfteeinwanderungsgesetz. Three pillars apply: the qualification pillar (recognised vocational qualification or degree, § 18a / § 18b AufenthG), the experience pillar (§ 19c(2) AufenthG with the Employment Ordinance — a state-recognised qualification from the home country plus at least two years of relevant experience and a minimum salary), and the EU Blue Card for academic roles. The Opportunity Card (Chancenkarte) is a job-search route, not an employer-sponsored one.

  3. 03Qualification Recognition (Anerkennung)

For the qualification pillar the Philippine diploma or vocational certificate must be recognised as equivalent by the competent German body — checked first in ANABIN and then through the formal Anerkennungsverfahren. Where a partial deficit is found, the employer and worker can use a Recognition Partnership (Anerkennungspartnerschaft, § 16d(3) AufenthG) to start work while the recognition is completed in Germany.

  4. 04Binding Contract and German Pay Levels

The employer issues a binding contract or a concrete job offer with the Federal Employment Agency's declaration of employment (Erklärung zum Beschäftigungsverhältnis). Pay and conditions must match those of comparable German employees — statutory minimum wage, any applicable collective agreement (Tarifvertrag) and, for the experience and Blue Card routes, the specific salary threshold in force for the year.

  5. 05Bundesagentur für Arbeit Approval

Most work-related residence titles require the internal approval of the Federal Employment Agency (§ 39 AufenthG). The BA verifies pay parity and working conditions; a priority check is no longer applied to skilled workers, but a comparability review is. Praxis prepares the file so the approval is not delayed by missing documents.

  6. 06Accelerated Skilled Worker Procedure (optional)

German employers can start the fast-track procedure under § 81a AufenthG at the local immigration office (Ausländerbehörde) with power of attorney from the worker. It bundles recognition, BA approval and visa pre-approval, and the embassy must then offer a visa appointment within three weeks against a fee.

  7. 07National D Visa at the Embassy

With the pre-approval, the worker files the national visa (category D) application at the German Embassy in Manila with the contract, recognition documents, passport, biometrics, proof of health insurance and — where required — a German language certificate. The visa is issued for entry and initial employment.

  8. 08DMW Processing

In parallel, Praxis completes the Philippine-side requirements — contract verification, Overseas Employment Certificate (OEC) and DMW clearances.

  9. 09Medical Clearance and PDOS

Candidates pass the DMW-accredited medical examination and attend the mandatory Pre-Departure Orientation Seminar covering the contract, their rights and German workplace expectations.

  10. 10Arrival Formalities in Germany

After entry the worker registers the address (Anmeldung) at the Bürgeramt, is enrolled by the employer in statutory health and social insurance from day one, opens a bank account and applies at the Ausländerbehörde for the electronic residence permit (eAT) that replaces the visa. Family reunification and, in time, permanent settlement follow the same file.

Typical timeline
Week 1–2

Intake, contracts and DMW job order

Week 2–6

Sourcing, screening and recognition check

Week 4–12

BA approval and visa pre-approval

Week 10–20

D visa, deployment and arrival formalities

Actual timing depends on employer readiness, how quickly the qualification is recognised, whether the accelerated procedure under § 81a AufenthG is used, Federal Employment Agency processing, document legalisation and embassy appointment slots in Manila for the national D visa. Praxis keeps each dependency visible before committing to a date.
